PUBLIC NOTICE REGARDING PAYMENTS TO CREDITORS WITH FINAL JUDGMENTS FROM THE SPECIAL CHAMBER OF THE SUPREME COURT OF KOSOVO

The Privatization Agency of Kosovo (PAK) informs all creditors that payments of funds are made in compliance with Law No. 04/L-034 and its relevant annex. The steps and requirements for the execution of these payments are explained below.
DOES THE COURT'S DECISION GUARANTEE IMMEDIATE PAYMENT?
No.
The final decision from the Special Chamber does not guarantee immediate payment. Furthermore, enforcement through private enforcement agent is not allowed, as this procedure must be suspended according to the Law (Article 10 of the Annex of the PAK Law).
HOW ARE PAYMENTS MADE?
- Payments are made only if the enterprise has sufficient funds.
- All creditors (with court decisions and decisions from the Liquidation Authority) are included in the distribution proportionally, according to the percentage determined by Law (Articles 40–42 of the PAK Law)
THE PROCEDURE FOLLOWED FOR DISTRIBUTION:
1. Verification of funds in the enterprise's bank account.
2. Request to the Special Chamber for the list of active appeals.
3. Assessment of the situation and preparation of the distribution report, if the requirements are met.
THREE MAIN REQUIREMENTS FOR DISTRIBUTION:

An amount must be reserved for those who still have appeals under review.

If these requirements are not met, payments cannot be made until:
- additional funds are generated (e.g., from the sale of assets), or
- the judicial processes in the Special Chamber of the Supreme Court of Kosovo are completed.
